FAQ
Frequently Asked Questions
Can I stay in Poland after my visa expires?
In certain circumstances, yes. If you apply for a residence permit before your legal stay expires and meet the formal requirements, your stay in Poland may remain legal while the application is being processed.
How long does a residence permit take?
It depends on the type of application and the individual case. Although statutory deadlines apply, in practice residence proceedings may take several months, especially if additional documents or explanations are required.
What if my application is refused?
You may usually have the right to appeal. The deadline is short, so the decision should be reviewed as soon as possible to determine the best course of action.
Can I work while waiting for a decision?
Not automatically. Whether you can legally work while your application is pending depends on your previous basis of employment and your individual immigration status.
Do I need to stay in Poland during the process?
Not necessarily. However, leaving Poland may affect your ability to return, as a pending residence application does not itself guarantee re-entry into Poland or the Schengen Area.
Can a lawyer handle the case for me?
Yes. A lawyer can represent you before the authorities, submit documents, review the case file and handle correspondence. Some formalities may still require your personal participation.
